Terms of Service

1. Acceptance of terms

By creating an account or using Tagsight ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Tagsight ("we", "us", "our").

2. Service description

Tagsight provides automated extraction of instrument data from P&ID (Piping and Instrumentation Diagram) documents. The service identifies instrument tags, classifies signal types per ISA 5.1, and generates formatted I/O lists for export. Results are provided for reference and must be reviewed by a qualified engineer before use in any engineering deliverable.

3. Account responsibilities

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to use the Service.
  • One person or entity per account. Sharing accounts is prohibited.

4. Credits and payment

  • Credits are purchased in packs and represent the number of P&ID pages you can process.
  • New accounts receive 5 free page credits upon email verification.
  • Credits are non-transferable between accounts.
  • Purchased credits do not expire.
  • All payments are processed by Stripe. We do not store your payment card details.
  • Prices are listed in USD and are exclusive of applicable taxes.
  • If a file fails to process due to a service error, credits are automatically restored.
  • For other refund requests, contact support within 30 days of purchase. Refunds are issued at our discretion for unused credits.

5. Intellectual property

Your content. You retain all rights to documents you upload and data extracted through the Service. We do not claim ownership of your content.

Our platform. The Tagsight platform, including its software, interface design, extraction algorithms, ISA classification logic, and documentation, is our proprietary property protected by intellectual property laws.

Feedback. If you provide suggestions or feedback about the Service, we may use it without obligation to you.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use automated systems (bots, scrapers) to access the Service beyond the provided API
  • Upload content that infringes third-party intellectual property rights
  • Attempt to circumvent rate limits, credit requirements, or access controls
  • Resell access to the Service without written authorization

7. Output accuracy and disclaimer

Extraction results are automatically generated and are provided "as is" for reference purposes only. Results are not engineering-of-record documents. You are solely responsible for reviewing, verifying, and approving all extracted data before incorporating it into any engineering deliverable, design document, or control system configuration. Tagsight does not guarantee the accuracy, completeness, or fitness of extracted data for any particular purpose.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE
  • ERRORS OR INACCURACIES IN EXTRACTED INSTRUMENT DATA
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
  • ANY OTHER MATTER RELATING TO THE SERVICE

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tagsight, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights; or (d) any claim that your uploaded content caused damage to a third party. This indemnification obligation will survive termination of these Terms and your use of the Service.

10. Dispute resolution and arbitration

Informal resolution. Before filing any formal dispute, you agree to contact us at support@tagsight.net and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration.Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding.

Individual basis only. You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Small claims exception.Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware.

12. Termination

You may terminate your account at any time by using the account deletion feature or contacting support. We may suspend or terminate your access at any time for violation of these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy. Unused credits are not refundable upon voluntary termination.

13. Changes to terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance. If you do not agree with modified terms, you must stop using the Service and delete your account.
